Tenancy in Common - EXAMPLE - Bob and Tom are friends, and own a house in equal shares (50/50). Bob and Tom both have children but are not married. Bob dies, now Bob's children are entitled to his 50%, and Tom still owns his 50%. When Tom dies, his children will inherit his 50%.
Joint Tenants with Rights of Survivorship - EXAMPLE - Bob and Tom are friends, and own a house in equal shares (50/50). Bob and Tom both have children, but are not married. If Bob dies first, then Tom gets the entire property automatically (100% ownership) and Bob's kids get nothing. If Tom dies first, then Bob owns the entire property automatically (100% ownership) and Tom's kids get nothing.

After the deed is prepared, we will send it to you so that you can get it signed, witnessed and notarized. Once that is completed, the deed will need to be recorded in public records. You are more than welcome to record the deed yourself, however our law firm can record the deed for you for an additional flat fee of just $99. After the deed is recorded and returned to our office, we will send the original to you for storage.
